The government had amended the law in 2019

In this, a provision was made to give Indian citizenship to six minorities (Hindus, Christians, Sikhs, Jains, Buddhists and Parsis) who came from Afghanistan, Pakistan and Bangladesh before 31 December 2014. According to the rules, the right to give citizenship rests with the Central Government. Will be in the hands of.

CAA implemented across the country, but it is outside the scope of state law, Mamata-Pinarai’s attitude also harsh

The Citizenship (Amendment) Act (CAA), 2019 has come into force across the country and the rules related to it have also been notified. Under this law, there is a provision to give citizenship to undocumented non-Muslim immigrants coming to India from Pakistan, Bangladesh and Afghanistan.

But there are many states in the country which will remain outside the purview of CAA. The Citizenship Amendment Act will not be implemented in most tribal areas of the North-Eastern states, including areas granted special status under the Sixth Schedule of the Constitution. Let us tell you that the CCA law was implemented on Monday.

Why will CAA not be implemented in these states of the country?

As per the law, the CCA will not be implemented in all the north-eastern states where people residing in other parts of the country require ‘Inner Line Permit’ (ILP) to travel. ILP is applicable in Arunachal Pradesh, Nagaland, Mizoram and Manipur. Officials quoted the rules and said that tribal areas where autonomous councils have been formed under the Sixth Schedule of the Constitution have also been kept out of the purview of CAA. There are such autonomous councils in Assam, Meghalaya and Tripura. This clearly means that Arunachal Pradesh, Nagaland, Mizoram and Manipur, Assam, Meghalaya and Tripura will remain out of the purview of CAA.

CAA protest in Assam

Protests against CAA have also started in Assam. All Assam Students Union has called for protests in Assam. The Joint Opposition Forum of 16 parties has announced a statewide bandh today. Copies of CAA were also burnt at some places in Assam. People associated with AASU will come to Delhi and appeal to the government to withdraw the CAA notification.

Assam Police has issued legal notices to 16 opposition political parties to call the bandh. The police warned the political parties and said that as per the order of the Gauhati High Court, cases may be registered against them. The 2023 order of the Guwahati HC states that the ‘bandh’ is illegal and unconstitutional. The HC has further directed that the government can recover from the protesters the economic loss caused due to the protest or strike. At the same time, the Chief Minister of Assam had warned that if the bandh is called, the registration of political parties may be stopped.

Kerala and Bengal governments also against CAA

The Central Government has implemented CAA but its implementation in Kerala and Bengal seems to be a very difficult task. In fact, the governments of both the states have refused to implement it. West Bengal Chief Minister Mamata Banerjee has said that if people are deprived of their rights through the rules of CAA, then she will fight against it. He says that implementing CAA is BJP’s election campaign and nothing else. Mamta appealed to the people to remain calm and avoid rumors.

Kerala has also been against the Citizenship Amendment Act since its inception. CM Pinarayi Vijayan says that his government has already said that it will not allow this law to be implemented in its state. Terming it a communal law, he said that the entire Kerala is united against it. He said that Kerala was the first state which passed a resolution in the Assembly in 2019 in protest against CAA, demanding the repeal of this law.

How will refugees get citizenship?
